REZIME

Svrha istraţivanja jeste tumaĉenje prve kodifikacije rimskog prava, kao i ispitivanje vaţnosti koju je ona
imala nekad i sad. Da bismo poĉeli sa tumaĉenjem zakonika prethodno smo morali istraţiti stanje u Rimu poĉetkom

perioda republike (509. p.n.e.) tj. kako je tekla borba staleţa i koji su njeni ishodi. Zatim smo rekli nešto o pravu pre

donošenja zakonika, tzv. starom civilnom pravu. Dalje su izloţene istorijske ĉinjenice vezane za naĉin i vreme
donošenja zakonika, kao i brojne tvrdnje koje izazivaju sporove. Za ovakve tvrdnje je u zagradama naznaĉeno iz koje

literature su preuzete. Ovaj deo u mnogome komentariše zakonik i spominje promene do kojih je došlo njegovim

objavljivanjem. U delu o rekonstrukciji je predstavljen raspored oderedbi po tablicama, a takoĊe su i tumaĉene same
odredbe. Nakon toga smo povukli paralelu izmeĊu Zakona XII tablica i prvih pravnih kodifikacija drugih naroda.

Time smo pokazali stepen njegove razvijenosti – prednosti i nedostatke u odnosu na druge zakonike.

SUMMARY

The point of research is to interpret the first codification of Roman law and also to check the importance that it had

than and now. Before interpreting the legal code we had to explore the situation in Rome at the beginning of republic
period (509 B.C.) that is how was the battle of classes passing and what were it‟s results. Then we said something

about law before passing the legal code, so called old civil law. Historical facts connected to the way and time of
passing the legal code and many statements that provoke disputes are presented next. For these statements in brackets

is pointed out from which literature are taken from. This part mostly comments the legal code and changes made by

it‟s passing. Order of regulations by tables is presented in the part about reconstruction, but regulations it selves are
also interpreted in this part. After that we draw the parallel between Law of XII tables and first law codifications of

other nations. By that we showed the level of it‟s development – advantages and disadvantages in regard to other
legal codes.
